1. General Conditions of Use
We invite you to carefully read these General Conditions of Use (or “General Conditions”) before using the services of Vacuum Tubes Treasures. By using the services of Vacuum Tubes Treasures and placing a purchase order on our site, you fully accept these General Conditions of Use.
The seller of the products on the site vacuumtubestreasures.com is Vacuum Tubes Treasures di Tiziano Di Natale, with headquarters in via Trento, 48 - 64011 - Alba Adriatica (TE) - ITALY, tax code DNTTZN73R27Z133P, VAT number 02113940676, telephone +39 328 7341456, (hereinafter referred to as Vacuum Tubes Treasures).
These general conditions of sale ("General Conditions") are governed by the Consumer Code (Legislative Decree no. 206/2005), section II, Distance Contracts (articles 50 – 67), by the provisions of the Civil Code on sales contracts in articles 1490 et seq., and by the rules on electronic commerce (Legislative Decree no. 70/2003) and apply to the sale via the Internet of the products present on the Vacuum Tubes Treasures website.
Vacuum Tubes Treasures reserves the right to modify these General Conditions, by prior notice published on the website. In the event of changes to the General Conditions, the General Conditions published on the website at the time the order is sent by the customer will apply to the purchase order.
The products and their prices presented on the website constitute an offer to the public, in accordance with the methods specified in the General Conditions and on the website itself.
Please note that to purchase products on the Vacuum Tubes Treasures website you must be of legal age. In the case of purchases made by a minor, the parents or the person exercising guardianship will be considered jointly liable.
To submit a purchase order, the customer has the following order procedures available:
· by email, using the Antispam form "Customer Service"
· by post, sending a purchase proposal to the address Vacuum Tubes Treasures di Tiziano Di Natale, via Trento 48 - 64011 - Alba Adriatica (TE) - ITALY;
· directly on the website - the customer successfully completes the order procedure if the website does not show any error messages: In the event that the customer wishes to proceed with the purchase, it is not necessary to register, the data provided will be used exclusively to proceed with the purchase; To submit a purchase order, the customer must provide the following data: name, surname, delivery address, payment method, postal/telephone/email address - in the case of purchases made by private individuals; name/company name, tax code and VAT number, registered office, delivery address, payment method, postal/telephone number/email address – in the case of purchases made by companies/freelance professionals.
Vacuum Tubes Treasures will confirm receipt of the purchase order by sending an “Order Receipt Confirmation” email to the email address provided by the customer. This confirmation will summarize the products chosen, their availability in stock, their prices, shipping costs, delivery address and order number.
The customer undertakes to verify the accuracy of the data contained in the order confirmation and to communicate any corrections within 12 (twelve) hours of receiving it. Possible additional costs caused by errors in the data not reported promptly will be borne by the customer. The order number must be used by the customer in all communications with Vacuum Tubes Treasures. Occasional unavailability of the products offered in stock may occur; in this case, if the products chosen by the customer are not, in whole or in part, immediately available, Vacuum Tubes Treasures will communicate this to the customer via email.
In the case of purchase by bank transfer, credit card or Paypal, Vacuum Tubes Treasures will proceed with the shipment of the chosen products only after receiving the payment. The customer will be sent a “Shipping Confirmation” email when the products are taken over by the courier in charge of delivery.
The prices of the products on the site are unit prices and are to be understood as VAT included or not subject to VAT if second-hand products.
The Customer expressly acknowledges that the indication of a VAT number in the purchase order automatically qualifies him/her as a business/freelancer – therefore, the rules contained in the Consumer Code (Legislative Decree 206/2005) cannot be applied to such transactions; instead, reference will be made to the provisions of the Civil Code, articles 1490 et seq., regarding sales contracts.
2. Warranty
All products offered by Vacuum Tubes Treasures are covered by a legal guarantee of conformity, as provided for by Legislative Decree no. 206/2005 (Consumer Code) and the provisions of the Civil Code relating to the sales contract (articles 1490 et seq.).
Definition and Scope of Application
The legal guarantee of conformity guarantees the customer that the products purchased will not present defects of conformity for a period of two years from the date of delivery (one year for used products, including NOS and/or NIB products from private collections).
With regard to thermionic valves, Vacuum Tubes Treasures offers a specific guarantee of 6 months from the date of delivery. This guarantee covers any obvious manufacturing defects that appear during normal use of the product. Defects or damage resulting from improper use, tampering, normal wear and tear or unsuitable operating conditions are not covered by the guarantee.
The guarantee includes the free repair or replacement of defective products. If these solutions are excessively expensive, the customer will be entitled to a price reduction or a refund in the form of a credit that can be used for future purchases at our store. The amount of such credit will be calculated based on the use made of the product.
Limitations of the Warranty
The warranty does not cover minor damage or defects that do not significantly impair the use of the product, nor damage resulting from improper use, tampering, normal wear and tear or inadequate maintenance. The practice of "tube rolling", i.e. the replacement of valves with others to vary the sound, is at the risk and discretion of the purchaser and does not give the right to returns or refunds.
The following are not covered by the warranty:
Accidental damage or damage resulting from use not in accordance with the manufacturer's instructions (manufacturer's datasheet).
Deterioration due to inadequate operating conditions or maintenance performed by unauthorized personnel.
Consumables and components subject to normal wear over time, such as thermionic valves, except in cases of obvious manufacturing defects present at delivery. Manufacturing defects must be reported in compliance with the warranty terms specified above.
How to Exercise the Warranty
The customer is required to inform Vacuum Tubes Treasures of any lack of conformity within 60 days of its discovery during the warranty period. In the first six months following delivery, it is assumed that any defects existed at the time of delivery, making the application of the warranty automatic. Subsequently, an expert assessment will be required to certify the origin of the defect, at the customer's expense.
Warranty Claim Information
To avail of the warranty, it is essential to present the original purchase invoice. Warranty requests can be sent to the email address vacuumtubestreasures@gmail.com or by post to: Vacuum Tubes Treasures di Tiziano Di Natale Via Trento n. 48 - 64011 Alba Adriatica (TE) - Italy.
The customer is also required to provide documentary evidence of the defect complained of via a short video sent on WhatsApp to the number +39 328 7341456 or by email to vacuumtubestreasures@gmail.com.
For those who purchase a product on Vacuum Tubes Treasures for purposes related to their business or professional activity - therefore communicating their VAT number and business data - the provisions of the Civil Code regarding sales contracts, articles 1490 et seq., will be applied. The guarantee, therefore, extends to 12 (twelve) months following delivery of the goods, while the communication of the lack of conformity must be made within 8 (eight) days of discovery.
3. Right of Withdrawal
Purchases made on the Vacuum Tubes Treasures website are governed by Italian law on distance contracts and purchases outside commercial premises, which you can find in Legislative Decree no. 206/2005, better known as the Consumer Code.
We undertake to refund the full amount of the goods as soon as possible and in any case within the legal deadline of 14 (fourteen) days from the date on which we receive the goods back.
THE GOODS MUST BE RETURNED EXACTLY AS THEY WERE SENT TO YOU, UNOPENED AND UNUSED.
RETURNS OR EXCHANGES ARE NOT ACCEPTED AFTER THE GOODS HAVE BEEN USED, THAT IS WITH THE PACKAGING SEAL BROKEN.
The consumer has the right to withdraw from the contract, without stating the reasons, within 14 days. The withdrawal period expires after 14 days from the day on which you or a third party, other than the carrier and designated by you, acquires physical possession of the goods. To exercise the right of withdrawal, you must inform us (Insert your name, geographic address and, if available, your telephone number and email address) of your decision to withdraw from this contract by means of an explicit declaration (for example, a letter sent by post, fax or email). To comply with the withdrawal deadline, it is sufficient for you to send the communication relating to the exercise of the right of withdrawal before the withdrawal period expires.
The right of withdrawal applies to purchased goods and therefore excludes the costs of delivery to the recipient which constitute a service that the recipient has used, even if free delivery was foreseen, it must be considered included in the surcharge of the goods, and therefore to be separated from the price paid.
Such refunds will be made using the same means of payment as you used for the initial transaction, unless otherwise expressly agreed; in any case, you will not have to bear any costs as a consequence of such reimbursement. The reimbursement may be suspended until the goods are received or until the consumer demonstrates that he has sent back the goods, whichever is earlier.

«You will be responsible for the costs of returning the goods.», The consumer is responsible for the decrease in value of the goods resulting from handling of the goods other than that necessary to establish their nature.
In these cases, however, we always recommend that you contact us, to provide you with further information and to find together the best solution for returning the goods, also through our couriers.

Consumer or non-consumer?
The protection of the Consumer Code applies to consumers or users, i.e. to “natural persons who act for purposes other than any entrepreneurial or professional activity they may carry out” (art. 3, paragraph 1, letter a) of Legislative Decree 206/2005). The right of withdrawal as presented here, therefore, cannot be exercised by legal persons and natural persons who act for purposes related to a commercial and/or professional activity. Purchases made by resellers or by persons who, in any capacity, purchase for resale to third parties are also excluded.
And what if we made a mistake?
In the event that you have received an item that you did not want due to our error, the right of withdrawal remains unchanged, but obviously the shipping costs for returning the goods will be at our expense. Contact us to find the simplest and fastest solution.
Damaged products. If you receive damaged goods, notify us within 5 (five) working days by email or telephone, citing "damaged items" in the subject of the email, or by telephone.

In case of payment via PayPal, in addition to the product prices and shipping costs, an order processing fee of 3% of the total purchase is applied. This fee covers the operational costs of managing the transaction. In case of a refund, the processing fee will not be refunded, as it covers the costs already incurred for managing and processing the order.

7. Competent Court
For civil disputes governed by the Consumer Code (Legislative Decree 206/2005), the competent Court will be that of the place of residence or domicile of the consumer, if located in the territory of the Italian State.
For any other dispute, the competent Court will be that of Teramo (Italy).
