1. General Conditions of Use
We invite you to carefully read these General Conditions of Use (or “General Conditions”) before using the Vacuum Tubes Treasures services. By using Vacuum Tubes Treasures' services and placing a purchase order on our site you fully accept these General Conditions of Use.

These general conditions of sale ("General Conditions") are governed by the Consumer Code (Legislative Decree Legislative Decree n 206/2005), section II, Distance contracts (arts. 50 – 67), by the provisions of the Civil Code regarding sales contracts in articles 1490 et seq., and by the rules on electronic commerce (Legislative Decree. Legislative Decree n 70/2003) and apply to the sale via the Internet of the products present on the Vacuum Tubes Treasures website.
Vacuum Tubes Treasures reserves the right to modify these General Conditions, subject to notice published on the site. In the event of changes to the General Conditions, the General Conditions published on the site at the time the order is sent by the customer will apply to the purchase order.
The products and related prices presented on the site constitute an offer to the public, in accordance with the methods specified in the General Conditions and on the site itself.
Please remember that to purchase the products on the Vacuum Tubes Treasures website you must be of age. In the case of purchases made by a minor, the parents or the person who exercises guardianship will be held jointly and severally liable.
To forward a purchase order, the customer has the following order procedures available:
· by email, using the Antispam "Customer Service" form

· directly on the site - the customer completes the order procedure correctly if the site does not highlight any error messages: If the customer wants to proceed with the purchase, there is no need to register, the data provided will be used exclusively to proceed with the purchase ; To submit a purchase order, the customer must provide the following data: name, surname, delivery address, payment method, postal/telephone/email address - in the case of purchases made by private individuals; company name/name, tax code and VAT number, registered office, delivery address, payment method, postal/telephone/email address - in the case of purchases made by businesses/freelance professionals.
Vacuum Tubes Treasures will acknowledge receipt of the purchase order by sending an "Order Receipt Confirmation" email to the email address communicated by the customer. This confirmation will summarize the selected products, their availability in stock, the relative prices, shipping costs, the delivery address and the order number.
The customer undertakes to verify the correctness of the data contained in the order confirmation and to communicate any corrections within 12 (twelve) hours of receiving it. Possible additional costs caused by errors in the data not reported promptly will be borne by the customer. The order number must be used by the customer in all communications with Vacuum Tubes Treasures. It is possible that there may be occasional unavailability of the products offered in stock; in this case, if the products chosen by the customer are not, in whole or in part, immediately available, Vacuum Tubes Treasures will communicate this to the customer via email.
In the case of purchases by bank transfer, credit card or Paypal, Vacuum Tubes Treasures will proceed with shipping the chosen products only after receiving payment. A "Shipping Confirmation" email will be sent to the customer when the products are picked up by the courier responsible for delivery.
The prices of the products on the site are unitary and include VAT or not subject to VAT if second-hand products.
The Customer expressly acknowledges that the indication of a VAT number in the purchase order automatically qualifies him as a company/freelance professional - these transactions, therefore, cannot be applied the rules contained in the Consumer Code (Legislative Decree Legislative Decree 206/2005); instead, reference will be made to the provisions of the Civil Code, to the articles. 1490 et seq., regarding sales contracts.
2. Warranty
All products that can be purchased on Vacuum Tubes Treasures are covered by a warranty, as regulated by Legislative Decree. Legislative Decree n 206/2005 (Consumer Code) and by the Civil Code, in the part dedicated to the sales contract, in articles. 1490 et seq.
What is the guarantee.The guarantee means the commitment undertaken by Vacuum Tubes Treasures towards the customer to repair or replace free of charge and within a reasonable time the products or components of the appliances which present defects of conformity in the manufacturing or in the material. If the repair or replacement of the goods proves to be excessively expensive or problematic, the customer can obtain a price reduction or use the sum of money to which you are entitled, as credit in our store for any other new item or used of your choice. To determine the amount of the price reduction or the sum to which the customer is entitled in these cases, the use that has been made of the product is taken into account.
Remember that minor defects, for which repair or replacement is not possible or excessively expensive, do not give the right to terminate the contract.
If the product you purchased is defective, contact us immediately so we can find the solution best suited to your needs.
Different customers, different ways of exercising the guarantee.
For consumers - i.e. for "natural persons who act for purposes unrelated to any entrepreneurial or professional activity carried out" (art. 3, paragraph 1, letter a) of the Legislative Decree. Legislative Decree 206/2005) – the guarantee extends to two years following delivery of the goods, for new products. For second-hand products, including NOS and/or NIB products from private collections, the warranty is one year.
To exercise your right, you must notify us of the lack of conformity you have discovered no later than 60 (sixty) days from discovery.
For the first six months from delivery of the product, it is assumed that the lack of conformity found existed from the origin, therefore the application of the guarantee is automatic. From the seventh month until expiry, however, the lack of conformity must be demonstrated with a specific assessment at your expense.
The consumer, in any case, is the owner of the rights provided for by the Consumer Code in articles. 128 – 135, which are not modified by this guarantee.
Those who purchase a product on Vacuum Tubes Treasures for purposes relating to their business or professional activity - therefore communicating the VAT number and the data of their activity - will be the provisions of the Civil Code regarding sales contracts have been applied, in articles 1490 et seq.
The guarantee, therefore, extends to 12 (twelve) months following delivery of the goods, while communication of the lack of conformity must be made within 8 (eight) days of discovery.

The guarantee will be recognized by presenting the original purchase invoice or sales document. Keep it carefully.
The legal guarantee of conformity, as defined by the Consumer Code, covers defects in conformity that appear within two years of delivery of the product. However, this warranty does not cover damage caused by normal wear and tear resulting from normal use of the product.
In the case of thermionic valves and other products subject to wear, the warranty does not cover the normal deterioration of the product over time or any damage resulting from improper use.
The warranty does not cover: · Accidental damage or damage caused by loss, non-use of the product, tampering, normal wear and tear, or loss of information made available to the customer at the time of sale.
· Damage that may, directly or indirectly, arise to people, things or animals as a result of failure to observe the provisions indicated in the appropriate operating manuals and concerning, in particular, the warnings regarding Installation, Use and Product maintenance. For such damages Vacuum Tubes Treasures declines any type of responsibility.
· Damage caused by negligence, incorrect use and installation and not compliant with the warnings and indications given in the instruction or installation manual; damage from misuse, mistreatment, deterioration, lightning, atmospheric phenomena, overvoltages and overcurrents, insufficient or irregular electrical power supply, adaptation or modification, nor damage caused by incorrect use or in contradiction with the technical measures and safety requirements in the country in which the appliance is used.
· Damage or malfunctions resulting from replacements or repairs carried out directly by the customer or by third parties, using parts not authorized by the relevant manufacturers or not complying with appropriate safety and quality measures.
· Consumable parts subject to normal wear and tear, such as light bulbs, lamps, batteries, etc.
3. Right of Withdrawal
Purchases made on the Vacuum Tubes Treasures website are governed by Italian legislation regarding distance contracts and off-premises purchases, which you can find in Legislative Decree. Legislative Decree n 206/2005, better known as the Consumer Code.
We undertake to refund the full amount of the goods as soon as possible and in any case within the legal deadline of 14 (fourteen) days from the date on which we receive the goods back.
GOODS MUST BE RETURNED EXACTLY AS THEY WERE SENT TO YOU, UNOPENED AND UNUSED.
NO RETURNS OR EXCHANGES ARE ACCEPTED AFTER THE GOODS HAVE BEEN USED, I.E. WITH THE PACKAGING SEAL BROKEN.
The consumer has the right to withdraw from the contract, without giving reasons, within 14 days. The withdrawal period expires 14 days after the day on which you or a third party, other than the carrier and designated by you, acquires physical possession of the goods. To exercise the right of withdrawal, you are required to inform us (Insert name, geographical address and, if available, telephone number and e-mail address) of your decision to withdraw from this contract through an explicit declaration (e.g. letter sent by post, fax or email). To comply with the withdrawal deadline, it is sufficient for you to send the communication relating to the exercise of the right of withdrawal before the withdrawal period expires.
The right of withdrawal applies to goods purchased and therefore excludes delivery costs to the recipient which constitute a service that the latter has used, even if free delivery was provided, it must be considered included in the mark-up for the goods , and therefore to be separated from the price paid.
These refunds will be made using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not incur any costs as a consequence of such reimbursement. The refund may be suspended until receipt of the goods or until the consumer demonstrates that he has sent the goods back, whichever is earlier.

«The costs of returning the goods will be your responsibility.», The consumer is responsible for the decrease in the value of the goods resulting from handling the goods other than that necessary to establish their nature.
In these cases, however, we always recommend that you contact us, to provide you with further information and to find together the best solution for returning the goods, also through our couriers.

Consumer or non-consumer?
The protection of the Consumer Code applies to consumers or users, i.e. to "natural persons who act for purposes unrelated to entrepreneurial activity or professional activity possibly carried out" (art. 3, paragraph 1, letter a) of the Legislative Decree. Legislative Decree 206/2005) The right of withdrawal as presented here, therefore, cannot be exercised by legal entities and natural persons acting for purposes related to a commercial and/or professional activity. Purchases made by resellers or by individuals who purchase for any reason for resale to third parties are also excluded.
And what if we made a mistake?
In the event that you received an item that you did not want due to our error, the right of withdrawal remains unchanged, but obviously the shipping costs for returning the goods they will be at our expense. Contact us to find the simplest and quickest solution.
Damaged products. If you receive damaged goods, please notify us within 5 (five) working days via email or telephone, quoting "damaged items" in the subject of the email, or via telephone.

7. Competent Court
For civil disputes governed by the Consumer Code (Legislative Decree Legislative Decree 206/2005), the competent court will be that of the place of residence or domicile of the consumer, if located in the territory of the Italian State.
For any other dispute, the competent court will be that of Teramo (Italy).
