1. Seller Identity and Contact Details
The products offered on vacuumtubestreasures.com are sold by Vacuum Tubes Treasures di Tiziano Di Natale, with registered office at Via Trento 48, 64011 Alba Adriatica (TE), Italy, Italian tax code DNTTZN73R27Z133P, VAT number 02113940676, telephone +39 328 7341456, email info@vacuumtubestreasures.com, hereinafter also referred to as “VTT” or the “Seller”.
2. Scope of Application
These Terms and Conditions govern purchases concluded through the VTT website. Purchases made through third-party platforms, including eBay, are also subject to the terms, conditions and procedures of the platform used, without prejudice to the consumer’s mandatory statutory rights.
Contracts with consumers are governed by Italian Legislative Decree No. 206 of 6 September 2005 (the “Italian Consumer Code”), Italian Legislative Decree No. 70 of 9 April 2003, the applicable provisions of the Italian Civil Code and European Union law. Consumer protections do not apply to purchases made for professional or business purposes.
Each order is governed by the version of these Terms and Conditions available at the time the contract is concluded. Subsequent amendments do not affect orders already concluded, except where mandatory provisions provide otherwise.
3. Orders, Availability, Prices and Payment
An order constitutes an offer to purchase. The contract is concluded when VTT confirms the order. VTT may cancel an order in the event of subsequent unavailability, an obvious error in the price or description, a reasonable suspicion of fraud, incomplete information, or legal or practical impossibility of completing the shipment. Any amounts already collected will be refunded.
The price, taxes and shipping costs are those displayed at checkout. Customs duties, import taxes and charges imposed by the destination country, where not expressly included, are borne by the buyer.
4. Product Classification and Characteristics
4.1 Newly Manufactured Products
These are products manufactured in recent times and sold as new, unless otherwise stated in the product listing.
4.2 NOS and NIB Products
The terms NOS (“New Old Stock”) and NIB (“New In Box”) describe older-production products declared unused or preserved in their original packaging. Age, materials and storage conditions may result in normal cosmetic or packaging variations. The applicable commercial and legal classification is the one expressly stated in the individual product listing; NOS and NIB products are not automatically classified as used. The commercial classification stated in the product listing forms an essential part of the contractual description.
4.3 Vintage and Used Products
Vintage or used products may show signs of age, insertion marks, fading, worn or partially erased printing, deteriorated packaging or other characteristics consistent with their age, origin and previous use. Characteristics expressly described or clearly visible in the photographs form part of the agreed qualities of the goods and do not constitute a lack of conformity.
Unless expressly stated to be representative, the photographs show the actual item or items offered. Minor colour differences caused by the display device do not constitute a defect.
5. Used Products: Liability Period for Lack of Conformity
For every product expressly classified and sold as used, VTT and the consumer agree that the Seller’s liability period for lack of conformity is limited to one year from delivery, to the extent permitted by Article 133(4) of the Italian Consumer Code. This one-year limitation forms an essential part of the contract and is stated both in the used product listing and in these Terms and Conditions.
For products not classified as used, the liability period provided by applicable law shall apply. The age of a product or the NOS/NIB designation alone does not automatically result in application of the shorter period.
6. Compatibility, Installation and Operating Conditions
Before purchase, the buyer must verify the electrical, mechanical and functional compatibility of the tube with the intended equipment. A matching type designation does not replace verification of pin configuration, voltages, currents, dissipation limits, bias settings, socket condition and the equipment manufacturer’s instructions.
- Installation must be carried out with the equipment switched off and disconnected from the mains and, where required, by qualified personnel.
- VTT is not responsible, unless an original lack of conformity is proven, for damage caused by defective or incompatible equipment, incorrect bias, overvoltage, excessive dissipation, oscillation, short circuits, inadequate ventilation, worn sockets, unsuitable adapters or tampering.
- Bent or broken pins, unusual abrasions, signs of arcing, overheating or alterations occurring after delivery will be taken into account during the technical inspection.
7. Testing, Matching and Sound Descriptions
Test results refer to the tester, calibration, method and operating point stated in the listing. Readings obtained using different equipment or conditions may not be directly comparable. Matching describes the consistency recorded according to the stated parameters and does not guarantee absolute identity in every circuit or throughout the entire service life.
Sound descriptions are provided solely for guidance and describe characteristics generally associated with the relevant tube type under compatible operating conditions. Sound preference, dissatisfaction, perceived differences compared with other tubes, tube rolling and comparative testing do not constitute a lack of conformity and are not handled as warranty claims free of charge.
Technical and photographic documentation collected by VTT before shipment is retained for traceability, after-sales assistance and the management of any disputes.
8. Statutory Guarantee of Conformity
Consumers are entitled to the statutory guarantee of conformity provided by the Italian Consumer Code. It covers lack of conformity existing at the time of delivery and becoming apparent within the applicable liability period.
The following do not constitute a lack of conformity, unless proven otherwise under applicable law: normal wear; progressive loss of emission; natural variations in parameters during the product’s service life; declared characteristics; ageing consistent with the nature and age of the goods; damage or alterations arising after delivery; and consequences of installation, use or operating conditions that do not comply with the applicable specifications.
VTT does not provide a separate commercial warranty unless expressly stated in the individual listing. Any commercial warranty is additional to, and does not limit, the statutory guarantee.
9. Reporting and Inspecting an Alleged Defect
The customer must contact VTT describing the issue and, where reasonably necessary, provide photographs, videos, equipment details, voltage readings, bias settings, operating conditions and available measurements. VTT may request the return of the product for visual inspection, electrical and functional testing, and comparison with photographs, electrical test results, matching data, identifying images and technical documentation archived by VTT before shipment.
Any technical inspection performed by VTT constitutes an objective element in evaluating the returned product, together with the available technical and photographic documentation.
The product must be returned properly packaged and in accordance with the instructions provided. If a lack of conformity is confirmed, the applicable remedy will be provided free of charge within the limits established by law. If the reported defect is not found and the product is confirmed to conform, VTT may return it to the customer and charge only those reasonable, actual and documented costs that applicable law does not require the Seller to bear, subject to prior notice.
10. Remedies for Lack of Conformity
Where a lack of conformity is confirmed, the remedies, order of priority, conditions and limitations provided by applicable law shall apply, taking into account whether a remedy is impossible or disproportionate, the availability of an equivalent product and the characteristics of the goods.
A vacuum tube is a sealed vacuum component and, as a general rule, cannot be technically repaired without destroying its structure and characteristics. Where repair is not feasible, the remedy required by law that is actually available and proportionate shall apply, without any automatic right to replacement where replacement is impossible or disproportionate.
Any national provisions implementing Directive (EU) 2024/1799 shall apply to the relevant contracts from their applicable date, without extending obligations to product categories or remedies to which they do not apply or that are technically impossible to perform.
11. Right of Withdrawal
Consumers may exercise the right of withdrawal within fourteen (14) days from delivery, in the cases and according to the procedures provided by the Italian Consumer Code, by sending an unequivocal statement to info@vacuumtubestreasures.com or by using any online function made available for this purpose.
The goods must be returned without undue delay and, in any event, within fourteen (14) days after notice of withdrawal, complete with the packaging, accessories, documentation and protective materials received. The direct cost of returning goods following a change of mind is borne by the consumer. VTT does not provide free return labels for such returns unless expressly agreed in the individual case.
VTT refunds only the amounts required by law, including the original standard delivery costs. Additional charges relating to more expensive delivery methods are not refundable. The refund may be withheld until the goods have been received or until proof of return shipment has been provided, as permitted by law.
12. Condition of Returned Goods and Diminished Value
The consumer is responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Every return is subject to technical, visual and commercial inspection.
Installation, powering, burn-in, tube rolling, comparative testing, use in multiple devices and manipulation of the pins may alter the tube’s technical and commercial condition and may result in a significant reduction in value. A tube sold as new, NOS, NIB, unused or collector-grade may no longer be marketable in the same category after installation or powering.
Any diminished value will be determined on the basis of the documented difference between the original value and the actual resale value of the returned product, assessed according to objective and documentable criteria, taking into account missing or damaged packaging, missing accessories, worn printing, marked, bent or altered pins, a broken seal and any other evidence of installation, use or handling. No automatic percentage deductions are applied.
13. Tamper-Evident Seal
Where present, the tamper-evident seal identifies the condition of the product as verified by VTT at the time of shipment and serves documentary and evidential purposes. If the seal is broken, VTT will carry out a thorough inspection of the product’s technical and commercial condition. Together with any other findings, this may contribute to establishing installation, handling or use and the resulting diminished value.
14. International Returns, Customs and Charges
For every return from a non-EU country, the customer must request and follow VTT’s customs instructions, correctly declare the goods as returned merchandise and, where available, refer to the original export. Incorrect declarations, unapproved values or lack of cooperation may result in customs duties, taxes, storage charges and re-importation costs, which may be charged to the customer where permitted by law and properly documented.
In the event of withdrawal, return shipping costs and any directly related charges are borne by the consumer, unless mandatory law provides otherwise. Where a lack of conformity is confirmed or the return results from an error attributable to VTT, the rules governing free remedies shall apply.
15. Unclaimed, Refused or Abandoned Shipments
The customer must provide correct information, monitor the shipment, cooperate with the carrier and customs authorities, and pay any applicable import charges. Failure to collect, refusal of delivery or failure to complete customs clearance does not automatically constitute exercise of the right of withdrawal.
If the shipment returns to VTT, any refund will be assessed after receipt and may be reduced by the actual, reasonable and documented costs attributable to the customer, including return transport, storage, customs clearance and re-importation, within the limits permitted by law. If the goods are confiscated, destroyed or declared abandoned and cannot be recovered for reasons attributable to the customer, the refund may be refused to the extent of the unrecoverable value and the costs incurred.
VTT is not responsible for any charges imposed by the carrier or customs authorities as a result of the customer’s failure to collect the shipment.
16. Liability
Nothing in these Terms and Conditions excludes or limits liability that cannot lawfully be excluded. In dealings with business customers, except in cases of wilful misconduct or gross negligence and to the extent permitted by law, VTT shall not be liable for indirect losses, loss of profit, equipment downtime or incompatibility not disclosed before purchase.
17. Invoicing and Tax Regime
Vacuum Tubes Treasures di Tiziano Di Natale operates under the Italian flat-rate tax regime pursuant to Article 1, paragraphs 54–89, of Italian Law No. 190 of 23 December 2014. For transactions deemed to take place in Italy, the tax treatment provided by applicable law shall apply.
For B2C distance sales of newly manufactured vacuum tubes and other VAT-liable products made to consumers resident in other EU Member States, where the OSS scheme applies, the price displayed and paid by the customer is a final price inclusive of the VAT due in the destination country. VAT is not added after payment: Vacuum Tubes Treasures di Tiziano Di Natale calculates the applicable VAT, deducts it from the amount received, declares it and pays it through the OSS scheme using the rate applicable in the Member State where the shipment ends.
Any technical indication of a 0% VAT rate displayed by Shopify, eBay or in their related summaries does not mean that the transaction is VAT-exempt or outside the scope of VAT and does not result in any additional charge to the customer. The applicable VAT remains included in the final price and is accounted for by Vacuum Tubes Treasures di Tiziano Di Natale through OSS.
The OSS treatment described above applies only to transactions falling within its scope. Used, NOS, NIB or vintage products may be subject to different tax treatment depending on their classification and the applicable legislation. The treatment actually applied is shown at checkout and in the relevant commercial documentation.
18. Applicable Law and Disputes
For consumers resident in the European Union, any mandatory protections provided by the law of their country of residence remain unaffected. For transactions with business customers, the Court of Teramo shall have exclusive jurisdiction unless otherwise agreed in writing.

Operational procedures, returns and refunds are also governed by the “Returns, Withdrawal and Refund Policy”, which supplements these Terms and Conditions without altering their principles.
