These general conditions of sale ("General Conditions") are governed by the Consumer Code (Legislative Decree no. 206/2005), section II, Distance contracts (articles 50 - 67), by the provisions of the Civil Code regarding sales contracts in articles 1490 and following, and by the rules on electronic commerce (Legislative Decree no. 70/2003) and apply to the sale of products on the Vacuum Tubes Treasures website.
Vacuum Tubes Treasures re reserves the right to modify these General Conditions, subject to notice published on the site. In the event of changes to the General Conditions, the General Conditions published on the site at the time the order is sent by the customer will apply to the purchase order.
The products and relative prices presented on the site constitute an offer to the public, in accordance with the methods specified in the General Conditions and on the site itself.

To submit a purchase order, the customer has the following procedures available: 'order:

· directly on the site – the customer completes the order procedure correctly if the site does not show any error messages: In the event that the customer wishes to proceed with the purchase, it is not necessary to register, the data provided will be used exclusively to proceed with the purchase; To submit a purchase order, the customer must provide the following data: name, surname, delivery address, payment method, postal/telephone/email address – in the case of purchases made by private individuals; name/company name, tax code and VAT number, registered office, delivery address, payment method, postal/telephone/email address – in the case of purchases made by companies/freelancers.
Vacuum Tubes Treasures will acknowledge receipt of the purchase order by sending an "Order Receipt Confirmation" email to the email address provided by the customer.This confirmation will summarize the selected products, their availability in the warehouse, the relative prices, shipping costs, the delivery address and the order number
The customer undertakes to verify the correctness of the data contained in the order confirmation and communicate any corrections within 12 (twelve) hours of receiving it. Possible increases in costs caused by errors in the data not reported in a timely manner will be charged to the customer. The order number must be used by the customer in any communication with Vacuum Tubes Treasures. It is possible that there may be occasional unavailability of the products offered in stock; in this case, if the products chosen by the customer are not, in whole or in part, immediately available, Vacuum Tubes Treasures will notify the customer by email.
In the case of purchase by bank , credit card or Paypal, Vacuum Tubes Treasures will proceed with the shipment of the selected products only after receiving the payment. The customer will be sent a "Shipping Confirmation" email when the products will be taken over by the courier in charge of the delivery.
The prices of the products on the site are unitary and from understood as VAT included or not subject to VAT if second-hand products.
The Customer expressly acknowledges that the indication in the purchase order of a VAT number automatically qualifies him as a company / freelancer – therefore, the rules contained in the Consumer Code (Legislative Decree 206/2005) cannot be applied to these transactions; instead, reference will be made to the provisions of the Civil Code, to articles 1490 and following, concerning sales contracts.
2. Guarantee
All products that can be purchased on Vacuum Tubes Treasures are covered by a guarantee, as governed by Legislative Decree no. 206/2005 (Consumer Code) and by the Civil Code, in the part dedicated to the sales contract, to articles 1490 et seq.
What is the guarantee. By guarantee we mean the commitment assumed by Vacuum Tubes Treasures towards the customer to repair or replace free of charge and within a reasonable time the products or the components of the appliances that present defects of conformity in the manufacturing or in the material. Should the repair or replacement of the goods prove excessively expensive or problematic, the customer can obtain a reduction in the price or termination of the contract. To determine the amount of the price reduction or the sum to which the customer is entitled in these cases, account is taken of the use that has been made of the product.
Remember that defects of minor entity, for which it is not possible or excessively expensive to proceed with the repair or replacement, do not give the right to terminate the contract.
If the product you have purchased is defective , contact us immediately, in order to find the solution that best suits your needs.
Different customers, different ways to exercise the guarantee.
For consumers - i.e. for "natural persons who act for purposes unrelated to any business or professional activity carried out" (art. 3, paragraph 1, letter a) of Legislative Decree 206/2005) - the guarantee extends to the following two years upon delivery of the goods. For second-hand products, the guarantee is one year.
To exercise your right, you must notify us of the lack of conformity you have found within and no later than 60 (sixty) days from its discovery.
For the first six months after delivery of the product, it is assumed that the lack of conformity found existed from the origin, therefore the application of the guarantee is automatic.From the seventh month, until the expiry of two years, however, the lack of conformity will be demonstrated with a special report at your expense
The consumer, in any case, is the holder of the rights provided for by the Code of Consumption in Articles 128 – 135, which are not modified by this guarantee.
To those who, on the other hand, purchase a product on Vacuum Tubes Treasures for purposes related to their business or professional activity - communicating , therefore, the VAT number and the data of one's business - the provisions of the Civil Code regarding sales contracts will be applied, in articles 1490 and following.
The guarantee, therefore, extends to 12 (twelve) months following the delivery of the goods, while the communication of the lack of conformity must be made within 8 (eight) days of discovery.

The guarantee will be recognized on presentation of the invoice of purchase or the original sales document.
The warranty does not cover: · Accidental damage or damage caused by loss, non-use of the product, tampering, normal wear and tear, or loss of information made available to the customer at the time of sale.
· Damages that may, directly or indirectly, derive to people, things or animals as a result of failure to observe the provisions indicated in the specific operating and concerning booklets especially the warnings on installation, use and maintenance of the product. For such damages, Vacuum Tubes Treasures declines any type of responsibility.
· Damage caused by negligence, incorrect use and installation and not compliant with the warnings and indications given in the instruction or installation manual; damage from misuse, abuse, deterioration, lightning, atmospheric phenomena, overvoltages and overcurrents, insufficient or irregular power supply, adaptation or modification, nor damage caused by incorrect use or in contradiction with technical measures and safety requirements in the country in which the appliance is used.
· Damage or malfunctions deriving from replacements or repairs carried out directly by the customer or by third parties, using parts not authorized by the relative manufacturers or not compliant appropriate safety and quality measures.
· Consumable parts subject to normal wear and tear, such as bulbs, lamps, batteries, etc.
3. Right of Withdrawal
Purchases made on the Vacuum Tubes Treasures website are governed by the Italian legislation on distance contracts and purchases away from business premises, which you can find in Legislative Decree no. 206/2005, better known as the Consumer Code.
We undertake to refund the full amount of the goods as soon as possible and in any case within the legal term of 14 (fourteen) days from date on which we will receive the goods back.
The consumer has the right to withdraw from the contract, without giving any reason, within 14 days. The withdrawal period expires after 14 days from the day on which you or a third party, other than the carrier and designated by you, acquires physical possession of the goods. To exercise the right of withdrawal, you must inform us (insert name, geographical address and, if available, telephone number and e-mail address) of your decision to withdraw from this contract by means of an explicit declaration (e.g. letter sent by post, fax or email).To meet the withdrawal deadline, it is sufficient for you to send the communication relating to the exercise of the right of withdrawal before the withdrawal period has expired
The right of withdrawal applies to purchased goods and therefore excludes the delivery costs to the recipient which constitute a service which the latter has used, even if free delivery was envisaged, it must be considered included in the recharge of the goods, and therefore to be separated from the price paid.
These refunds will be made using the same means of payment you used for the initial transaction, unless expressly agreed otherwise; in any event, you will not incur any costs as a result of such reimbursement. The refund may be suspended until receipt of the goods or until the consumer demonstrates that he has returned the goods, if earlier.

"You will be responsible for the costs of returning the goods.", The consumer is responsible for the decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish their nature.
In these cases, however, we always advise you to contact us, to provide you with further information and to find a solution together better for the return of the goods, also through our couriers.

Consumer or non-consumer?
The protection of the Consumer Code applies to consumers or users, i.e. to "natural persons who act for purposes unrelated to any business or professional activity carried out" (Article 3, paragraph 1, letter a) of Legislative Decree 206/2005). The right of withdrawal as presented here, therefore, cannot be exercised by legal persons and natural persons acting for purposes related to a commercial and/or professional activity. Purchases made by resellers or by subjects who in any capacity purchase for resale to third parties are also excluded.
What if we made a mistake?
In in the event that you have received an item that you did not want due to our mistake, the right of withdrawal remains unchanged, but obviously the shipping costs for returning the goods will be at our expense. Contact us to find the simplest and fastest solution.
Products damaged. If you receive damaged goods, notify us within 5 (five) working days via email or telephone, quoting "damaged items" in the subject of the email, or via telephone.
